LEGAL DEFINITION FOR HIT-AND-RUN IN THE STATE OF GEORGIA
- The driver of any vehicle that is involved in an accident that either results in injury or death of a person or in damage to the vehicle shall stop at the scene of the accident or as close as possible and render assistance.
- The driver shall give their name, address, and vehicle registration.
- The driver shall show their driver's license.
- The driver shall offer reasonable assistance to the other injured in the auto accident.
- The driver shall ensure medical personnel are called if the other driver is unconscious, appears deceased, or cannot communicate.
- The driver must remain at the scene until local law enforcement are contacted to report the accident.
Georgia takes hit-and-run crimes much more serious than even a DUI. This is because you have willfully decided to disobey the law and leave the scene of an accident. It is looked upon as you putting lives at risk. This is because you could leave the other person seriously injured without help. Victims have died because no one called 911.
The penalties for hit-and-run in the state of Georgia includes:
- The driver is guilty of a felony if the accident caused death or severe injury and will face one to five years in prison and at least a four-month driver’s license suspension.
- If you’ve been convicted of prior offenses, you could face a “hard suspension” of your license.
- The driver is guilty of a misdemeanor if the accident was not serious and did not damage the vehicle and will face a fine between $300 and $1,000 and/or jail time up to 12 months in prison.
- A second conviction within 5 years results in a fine between $600 and $1,000 and/or 12 months in jail.
- A third conviction results in $1,000 fines and up to 12 months in jail.
